INTRODUCTION
These Terms and Conditions ("Terms") govern your access to and use of the services provided by DieseLogix LLC ("DieseLogix," "we," "us," or "our"), including our heavy-duty mobile diagnostic and repair services, our website at dieselogix.com, our automated messaging assistant ("Nicole"), and all related communication channels such as Facebook Messenger, Instagram Direct Messages, SMS, phone, and email.
By booking a service, contacting us through any channel, or using our website, you agree to be bound by these Terms. If you do not agree, do not use our services.
1. ELIGIBILITY
You must be at least 18 years old and legally authorized to enter into agreements on behalf of yourself, your fleet, your employer, or the owner of the vehicle you are requesting service for. By using our services, you represent and warrant that:
- You are at least 18 years of age.
- You have the legal authority to authorize repair work on the vehicle in question.
- The information you provide to DieseLogix is accurate, current, and complete.
- You will not use our services for any unlawful purpose.
2. SCOPE OF SERVICES
DieseLogix specializes in mobile heavy-duty truck diagnostic and repair services for:
- Volvo VNL, VNR, and VHD models (D13 engine)
- Mack trucks (MP8 engine)
- Other heavy-duty commercial trucks at our discretion
Services include but are not limited to: advanced electrical diagnostics, fuel injector replacement, aftertreatment systems and forced regens, ECM programming and tuning, advanced engine diagnostics, mobile DOT inspections, and roadside repair assistance.
Service availability is limited to Denver, Colorado and a 50-mile surrounding radius. Service outside the metro Denver area may incur additional travel charges (see Section 4).
3. APPOINTMENTS AND BOOKINGS
3.1 How to Book
You can request service through our website, by phone at (720) 724-9523, via Facebook Messenger, Instagram Direct Messages, or other authorized channels. When booking, you agree to provide:
- Your full legal name
- A working phone number where we can reach you
- Vehicle make, model, year, and identifying information
- Accurate description of the issue and current location
- A valid address where the service will be performed
3.2 Confirmation
A booking is not confirmed until DieseLogix sends a confirmation message (via SMS, Messenger, Instagram DM, or email). Approximate appointment windows are based on technician availability and may be adjusted due to traffic, weather, or prior service complications.
3.3 Your Responsibilities
You agree to:
- Be present (or have an authorized representative present) at the appointment location
- Ensure safe vehicle access for the technician
- Disclose any pre-existing damage, modifications, or relevant history of the vehicle
- Provide accurate vehicle identification documentation if requested
4. PRICING AND PAYMENT
4.1 Standard Pricing
- Callout fee: $99 per dispatch
- Labor rate: $169 per hour
- Minimum billable time for no-start issues: 2 hours
- Minimum billable time for warning light, derate, or running issues: 1 hour
- Minimum billable time for data link / communication network diagnostics (J1939/CAN): 2 hours
- Parts: priced separately from labor
- Outside the Denver metro service area: additional charge of $1.90 per mile
Prices are subject to change. The pricing in effect at the time of booking will apply to your service.
4.2 Estimates
All major repair work will be quoted before commencement via a written estimate delivered through our digital estimate system. You must approve the estimate before work begins. If work in progress reveals additional issues that exceed the original estimate by more than 10%, we will pause and obtain your approval before proceeding.
4.3 Payment Methods
We accept credit and debit cards, ACH bank transfers, and cash in person with receipt. Payment is due upon completion of services. After service, you will receive a secure payment link processed through Stripe.
4.4 Late Payment
Payments not received within 7 days of service completion may incur a late fee of 1.5% per month (18% per annum), to the extent permitted by Colorado law. Accounts more than 30 days past due may be referred to collections, and you agree to pay reasonable collection and legal fees.
5. CANCELLATION AND NO-SHOW POLICY
5.1 Cancellation by Customer
- Cancellations made more than 2 hours before the appointment: no charge.
- Cancellations made less than 2 hours before the appointment: the $99 callout fee is owed (because the technician is already dispatching).
- Cancellations after the technician has departed for your location: the $99 callout fee plus 1 hour of labor ($169) is owed.
5.2 No-Show
If the technician arrives at the agreed location and you (or your authorized representative) are not present, the vehicle is not accessible, or service cannot proceed for reasons within your control, you will be charged the $99 callout fee plus 1 hour of labor at $169.
5.3 Cancellation by DieseLogix
DieseLogix may cancel or reschedule appointments due to severe weather, road closures, emergencies, technician illness, safety concerns at the service location, or customer behavior that creates an unsafe environment. In such cases, you will not be charged any fee, and we will work with you to reschedule.
6. WARRANTY
6.1 Labor Warranty
DieseLogix warrants its labor for ninety (90) days or ten thousand (10,000) miles from the date of service, whichever occurs first.
6.2 Parts Warranty
Parts installed by DieseLogix are covered by the manufacturer's warranty, where applicable. DieseLogix will assist in processing manufacturer warranty claims but is not the warrantor of the parts themselves.
6.3 What Warranty Covers
If a defect in the labor performed by DieseLogix is identified within the warranty period, DieseLogix will re-perform the affected labor at no additional charge. You must notify us within the warranty period and grant access to inspect the vehicle.
6.4 What Warranty Does NOT Cover
The warranty does NOT cover:
- Pre-existing damage to the vehicle or related components
- Damage caused by third-party parts, repairs by other technicians, or modifications after our service
- Damage caused by misuse, abuse, accident, neglect, or improper maintenance
- Wear and tear consistent with normal vehicle use
- Indirect, consequential, or incidental damages such as lost income, towing fees, or lodging
- Issues unrelated to the work we performed
6.5 Warranty Voids
The warranty is void if the vehicle is serviced or modified by an unauthorized third party in the area we worked on, if the customer fails to make payment for the original service, or if the vehicle is used in a way that violates the manufacturer's specifications.
7. LIMITATION OF LIABILITY
DieseLogix provides services to a reasonable industry standard, but commercial heavy-duty truck repair carries inherent risks. To the maximum extent permitted by Colorado law:
- DieseLogix is not liable for indirect, incidental, special, consequential, or punitive damages, including lost revenue, lost profits, towing fees, lodging, cargo loss, business interruption, or substitute vehicle costs.
- DieseLogix's total aggregate liability for any claim arising out of or related to our services shall not exceed the amount you paid us for the specific service that gave rise to the claim.
- We are not responsible for pre-existing damage, issues caused by third-party parts, delays from weather or traffic, loss of personal property left inside the vehicle during service, or failures in vehicles we declined to service.
8. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless DieseLogix LLC, its owners, employees, contractors, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your breach of these Terms, your misuse of our services, inaccurate information you provided, or your violation of any law or third-party right.
9. AUTOMATED MESSAGING (NICOLE) AND AI
By messaging us through Facebook Messenger, Instagram Direct Messages, or other supported channels, you understand and agree that:
- Your messages may be processed by an automated assistant ("Nicole") powered by AI.
- AI-generated responses are intended to assist with scheduling, pricing inquiries, and basic service questions — they are NOT a substitute for professional diagnostic judgment.
- You may at any time request to speak with a human team member.
DieseLogix is not responsible for misunderstandings, errors, or omissions in automated AI-generated responses. Final pricing, service scope, and warranty terms are governed by the written estimate provided through our digital estimate system, NOT by AI conversations.
10. SMS COMMUNICATIONS
When you provide your phone number, you consent to receive transactional SMS messages from DieseLogix related to your service. Message and data rates may apply. Message frequency varies. Reply STOP to any SMS to opt out. Reply HELP for assistance. See our Privacy Policy for full SMS terms.
11. PROHIBITED USE
You agree NOT to misuse our website, services, or communication channels, attempt unauthorized access to our systems, impersonate another person or vehicle owner, provide false information to obtain service, use our services for illegal activity, send harassing or threatening communications to our team, or disrupt or scrape our automated systems.
Violation of any of these rules may result in termination of service, voiding of warranty, and pursuit of legal remedies.
12. INTELLECTUAL PROPERTY
All content on our website (logos, text, photography, videos, technical guides, blog articles) is the property of DieseLogix LLC or our licensors, and is protected by U.S. and international copyright and trademark laws. You may not reproduce, distribute, modify, or use our content for commercial purposes without our prior written consent.
13. THIRD-PARTY SERVICES AND LINKS
Our website may contain links to third-party websites (payment processing, social media). We are not responsible for the content or practices of any third-party site. Your interaction with our payment processor (Stripe) is governed by its own terms separate from these Terms.
14. GOVERNING LAW AND JURISDICTION
These Terms are governed by and construed under the laws of the State of Colorado, USA, without regard to its conflict-of-laws principles.
Any dispute arising out of or relating to these Terms, the services provided by DieseLogix, or your relationship with DieseLogix shall be brought exclusively in the state or federal courts located in Denver County, Colorado. You consent to the personal jurisdiction of those courts.
15. DISPUTE RESOLUTION
Before initiating any formal legal action, you agree to first contact us in writing at dispatch@dieselogix.com to attempt informal resolution. We will respond within 30 days. Either party may bring a claim in small claims court if the dispute qualifies under the rules of that court.
16. CHANGES TO THESE TERMS
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and post a notice on our website. Continued use of our services after changes constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using our services.
17. SEVERABILITY AND ENTIRE AGREEMENT
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and DieseLogix regarding our services.
